Introduction
Welcome to Book Reading Habit. Please read these Terms of Use ("Terms") carefully before using our application. By downloading, installing, or using the Book Reading Habit app ("Service"), you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Service.
Definitions
- App: (referred to as either "the App" or "the Service") refers to the mobile application known as Book Reading Habit
- Developer: (referred to as either "the Developer", "We", "Us" or "Our" in this Agreement) refers to Eduardo Stuart, an individual developer and provider of Book Reading Habit
- User: Any individual who downloads, installs, or uses the Book Reading Habit app
- App Store: The digital distribution service operated by Apple Inc. (Apple App Store)
- Country refers to: the Netherlands
User Eligibility
You represent that you are at least 13 years of age. If you are under 18 years of age, you represent that you have your parent's or legal guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.
License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the App for your personal, non-commercial purposes on devices that you own or control.
In-App Purchases and Subscriptions
- The Service offers optional in-app purchases and subscription options.
- All purchases and subscription transactions are processed through the App Store. These transactions are subject to the App Store's terms and conditions.
- Subscriptions will automatically renew unless auto-renew is turned off before the end of the current subscription period.
- Subscription management, including cancellation, can be accessed through your App Store account settings.
- Refund requests must be submitted to the App Store directly.
User data and privacy
- Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your information.
- Book information, reading progress, and other data you enter into the app is primarily stored on your device and may be synchronized through your personal iCloud account if you enable this feature.
- We do not sell your personal data to third parties or use it for advertising purposes.
User content and conduct
You agree not to use the Service for any purpose that is illegal or prohibited by these Terms, including:
- Violating any applicable laws or regulations
- Infringing upon the intellectual property rights of others
- Attempting to interfere with or disrupt the Service or servers connected to the Service
- Attempting to modify, reverse-engineer, or hack the Service
Third-Party Services and Links
- The Service may contain links to or integrate with third-party services or websites.
- We do not control, endorse, or assume responsibility for any third-party services or websites.
- Your use of such third-party services is subject to their respective terms of service and privacy policies.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
Limitation of liability
To the maximum extent permitted by law:
- The Service is provided on an "as is" and "as available" basis, without warranties of any kind.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles.
- Our total liability for any claims relating to the Service shall not exceed the amount you paid for the Service, if any, during the 12 months preceding the claim.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Country, without regard to its conflict of law provisions.
Dispute Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Developer.
For European Union (EU) Users
If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
